BPD Make Arrest in Restaurant Shooting

Buffalo police have made an arrest in connection with a fatal restaurant shooting that occurred Saturday morning, January 16th.

Central District police officers responded to calls regarding shots being fired at Merge restaurant at 439 Delaware Ave., late Saturday morning, and found two people had been shot.

Police learned that a lone gunman - the dishwasher - had shot at one employee who managed to duck and was unharmed. The suspect struck two others - a father and son, as they were preparing for the business day. Both victims were rushed to area hospitals by ambulance.

The son died at Buffalo General Hospital, the father was rushed to Erie County Medical Center where he is being treated for his wounds. Police identified the dead man as 18 year old Rick Costner Jr., who worked as a sous chef at the restaurant. His father, the general manager, was identified as Rick Costner Sr., 40 years old.

Police learned the suspect has been employed as a dishwasher at the restaurant for several months. He has been identified as Ernesto Arechavaleta-Taureaux, 51 years old of Porter Avenue.

Arechavaleta-Taureaux was disarmed by one of the other employees, and taken into police custody at the scene. Homicide and crime scene unit personnel arrived and spoke with witnesses and gathered evidence.

The suspect is charged with second degree murder as well as attempted second degree murder, and criminal possession of a weapon. Police did recover a 9mm handgun at the scene.
